Hainan: Implement the strictest farmland protection system and resolutely stop the "non-agricultural" behavior of cultivated land.

According to the news of Hainan Provincial Department of Natural Resources and Planning in August 12, with the consent of Hainan Provincial Government, Hainan Provincial Department of Natural Resources and Planning recently issued the Notice on Implementing the strictest farmland protection system to stop the "non-agricultural" behavior of cultivated land, demanding strict implementation of the "six prohibitions", resolutely stopping the "non-agricultural" behavior of cultivated land, implementing the strictest farmland protection system, and strictly observing the red line of cultivated land protection and the bottom line of food security.

The "Notice" includes: it is strictly forbidden to illegally occupy cultivated land for afforestation; It is strictly forbidden to build a green channel beyond the standard; It is strictly prohibited to illegally occupy cultivated land and dig lakes for gardening; It is forbidden to occupy permanent basic farmland and expand nature reserves; It is strictly forbidden to illegally occupy cultivated land for non-agricultural construction; It is forbidden to grant land in violation of laws and regulations.

The "Notice" puts forward three requirements: First, establish and improve the supervision mechanism of cultivated land satellite photos, comprehensively use satellite remote sensing, information technology and other means, coordinate all forces to supervise the protection and utilization of cultivated land and permanent basic farmland, and give priority to ensuring high-quality paddy fields and permanent basic farmland for grain production.

The second is to improve the working mechanism of early detection, early stop and strict investigation, implement the "field length system" management of cultivated land protection, implement grid supervision of cultivated land, establish a closed-loop system of law enforcement supervision in the whole process, and strengthen the "four in one" protection of cultivated land quantity, quality, ecology and benefit.

Third, natural resources and planning departments at all levels, agricultural and rural departments should strengthen communication and cooperation with development and reform, ecological environment, transportation, water affairs, forestry, comprehensive administrative law enforcement and other departments, strengthen bottom-line thinking, highlight problem orientation, take effective measures, strengthen law enforcement supervision, resolutely stop the "non-agricultural" behavior of all kinds of cultivated land, and resolutely hold the red line of cultivated land protection.

Six cities and counties in Hainan illegally occupy a large area of cultivated land.

Prior to this, on August 5, the Hainan Provincial Government held a warning interview on the enforcement of land and resources films, and interviewed six cities and counties, such as Danzhou, Qionghai, Wenchang, Ding 'an, Chengmai and Ledong, which occupied a large proportion and area of cultivated land illegally by law enforcement in 2020 and made slow progress in related special rectification work, to urge them to compact the main responsibilities of cities and counties and speed up the rectification work.

The Notice stipulates that it is forbidden to occupy cultivated land to plant trees that seriously damage the cultivated layer, and it is forbidden to occupy permanent basic farmland to plant seedlings, turf, eucalyptus and other plants that damage the cultivated layer. Illegal occupation of cultivated land and permanent basic farmland for afforestation, afforestation area shall not be approved, and financial subsidies at all levels shall not be enjoyed. It is forbidden to occupy cultivated land and permanent basic farmland in the name of urban and rural green belts and urban landscape park construction. Illegal occupation of cultivated land and afforestation of permanent basic farmland shall be stopped immediately.

Adhere to the economical and intensive use of land, scientific and rational layout of transportation infrastructure construction. Strictly control the approval of green belt land outside the scope of land use on both sides of railways and highways. The road is cultivated land, and the width of the green belt outside the scope of land use on both sides is not more than 5 meters, of which the county road and township road are not more than 3 meters. It is not allowed to occupy cultivated land and permanent basic farmland in violation of regulations in rivers, canals, lakes, reservoirs, ponds and wetlands. If it is really necessary to occupy permanent basic farmland, the formalities for approval and adjustment of permanent basic farmland occupation shall be fulfilled. The green space within the scope of traffic and water conservancy construction land shall go through the examination and approval procedures for construction land in strict accordance with the relevant provisions. It is forbidden to illegally occupy cultivated land in the name of urban and rural greening construction.

It is forbidden to occupy cultivated land and permanent basic farmland without authorization in the name of river course, wetland and lake management, and dig fields and lakes for landscaping. It is strictly forbidden to occupy cultivated land and permanent basic farmland to build artificial wetland parks and artificial water conservancy landscapes. If it is really necessary to build, and it is difficult to avoid occupying cultivated land and permanent basic farmland through scientific argumentation, it shall conform to the national spatial planning, go through the formalities for examination and approval of construction land and planning permission according to law, and adjust and supplement permanent basic farmland in accordance with relevant regulations. Those who fail to perform the examination and approval procedures and illegally occupy cultivated land and permanent basic farmland must stop immediately and make rectification within a time limit.

Nature reserves shall have clear boundaries and shall not occupy permanent basic farmland. At present, the permanent basic farmland that has been included in the core protection area of nature reserves should be included in the ecological conversion of farmland and withdrawn in an orderly manner. According to the functional orientation of nature reserves, nature reserves are reasonably divided. If the scattered permanent basic farmland in the general control area has a significant impact on the ecological function, it should be withdrawn in an orderly manner.

Strict examination and approval of rural construction land and the management of rural construction planning permission are not allowed to violate the national spatial planning for non-agricultural construction and indiscriminate occupation of cultivated land for housing. For all kinds of construction projects, temporary land, agricultural facilities, constructed wetlands and landscape greening projects that occupy cultivated land and permanent basic farmland without approval or do not meet the specified requirements, they should be dealt with severely according to the law and regulations, and ordered to make rectification within a time limit. Strictly prevent the problem of "big shed" from rebounding and consolidate the results of clean-up and rectification. Strengthen the management of protective agricultural land, strictly review the permanent basic farmland occupied by protective agricultural land, and standardize the storage of protective agricultural land projects on the map. Strictly implement the "land use right system", strengthen the dynamic monitoring of cultivated land and permanent basic farmland protection, build a normalized supervision mechanism for early detection, early stop and strict investigation, and seriously investigate and deal with illegal and indiscriminate occupation of cultivated land, especially permanent basic farmland.

It is strictly forbidden to evade the approval of occupying permanent basic farmland by adjusting the land and space planning without authorization. It is strictly forbidden to use it first without approval, not immediately, occupying several batches or occupying B. Strictly control the occupation of permanent basic farmland by construction, and general construction projects may not occupy permanent basic farmland. If major construction projects really need to be occupied, it is necessary to conduct on-the-spot reconnaissance on the necessity and rationality of occupation and the feasibility of supplementing the permanent basic farmland plan, strictly demonstrate and review them, and submit them for approval according to procedures. Strict management of temporary land, temporary land shall not be built permanent buildings or used for a long time beyond the prescribed period.

Houses newly built, expanded, continued or illegally sold after illegally occupying cultivated land on July 3 last year are all "headwinds"

According to the report on natural resources, from May to June this year, 42 typical cases of illegal occupation of cultivated land for building houses after July 2020 were reported by 17 provinces (autonomous regions and municipalities), and the Shenyang Bureau of National Natural Resources Supervision found 1 in the spot check. With the joint efforts of relevant local governments and relevant departments, as of July 7, 20021year, 40 cases have been rectified, and the other 3 cases are under rectification.

According to the bulletin of the Ministry of Natural Resources, on July 3, 2020, the State Council held a video conference to mobilize and deploy the rectification work of illegal occupation of cultivated land for housing in rural areas throughout the country, demanding that the new illegal occupation of cultivated land for housing be resolutely curbed with a "zero tolerance" attitude. The houses newly built, expanded, continued or illegally sold after the video conference in the State Council on July 3rd are all "against the wind".

The Ministry of Natural Resources emphasizes that all localities and relevant departments should maintain a high-pressure situation, strengthen the responsibilities of local party committees and governments at all levels in accordance with the decision-making arrangements of the CPC Central Committee and the State Council, implement the joint responsibility of the party and the government, severely investigate and deal with all kinds of illegal occupation of cultivated land or change of cultivated land use, take effective measures to implement the strictest cultivated land protection system, resolutely curb the "non-agricultural" of cultivated land, and strictly control the "non-grain". Those who have orders or prohibitions on the protection of cultivated land, dereliction of duty and dereliction of duty, should be seriously investigated for responsibility.
