"Notice" pointed out: "Pig breeding land is used as facility agricultural land, which is managed according to agricultural land, and there is no need to go through the examination and approval procedures for construction land. Under the premise of not occupying permanent basic farmland, reasonably arrange pig breeding space and allow pig breeding land to use general cultivated land. As a breeding purpose, there is no need to balance cultivated land. "

In addition, on February 7, 2009, the Ministry of Natural Resources and the Ministry of Agriculture and Rural Affairs jointly issued the Notice on Relevant Issues Concerning the Management of Protective Agricultural Land, which stipulated that: "Protective agriculture belongs to the internal structural adjustment of agriculture, and it can use general cultivated land without balancing occupation and compensation. In principle, farming facilities shall not use permanent basic farmland. A small amount of permanent basic farmland is really unavoidable, and it is allowed to be used but must be supplemented. "

Agricultural protected areas include protected areas directly used for crop planting and livestock and poultry breeding in agricultural production. Among them, the land for livestock and poultry breeding facilities includes the land for breeding production and the land for facilities directly related to manure treatment, inspection and quarantine, excluding the land for slaughtering and meat processing.

As can be seen from the above, it is really no longer necessary to go through the examination and approval procedures for farming construction land, but it does not mean that farming land does not need examination and approval, and farmers can build farms at will.

2. What departments should we go to and what procedures should we go through to build farms in rural areas?

According to the Animal Husbandry Law of People's Republic of China (PRC), Animal Epidemic Prevention Law of People's Republic of China (PRC), Regulations on Pollution Prevention of Large-scale Livestock and Poultry Breeding and other relevant laws and regulations, the construction, reconstruction and expansion of livestock and poultry farms (communities) shall conform to the development plan of animal husbandry and pollution prevention plan of livestock and poultry breeding, and meet the conditions of animal epidemic prevention.

(a) to start a farm on rural cultivated land shall meet the following conditions:

1. The farm construction conforms to the overall planning of villages and towns and the development planning of animal husbandry;

2. The site selection shall not occupy basic farmland;

3. The site selection meets the epidemic prevention conditions;

4. Meet the requirements of environmental protection.

(2) The following procedures are required:

1. Apply to the Township People's Government

The construction address shall conform to the plan and shall not be located in the livestock and poultry breeding forbidden area. The site selection shall comply with the relevant provisions of the Measures for the Examination of Animal Epidemic Prevention Conditions, otherwise the certificate of animal epidemic prevention conditions cannot be obtained.

The name, breeding address, variety and scale of livestock and poultry in farms and communities shall be filed with the animal husbandry and veterinary administrative department at the county level where the farms (communities) are located, and the identification code of livestock and poultry shall be obtained.

3 to the county natural resources department for land registration.

4. Go to the ecological environment department to declare the EIA procedures.

Large livestock and poultry farms (communities) that may have a significant impact on the environment shall prepare an environmental impact report; Other livestock and poultry farms (communities) shall fill in the environmental impact registration form.

In addition, those who are engaged in the production and operation of breeding livestock and poultry need to apply for the production and operation license of breeding livestock and poultry, which shall be examined and accepted by the administrative department of animal husbandry of the county and city, and approved and issued by the Provincial Department of Agriculture. The administrative department for industry and commerce shall handle the registration according to law with this certificate.
