Detailed Rules for the Implementation of Land Requisition Compensation in Duanzhou Urban Planning Area

Article 1 In order to strengthen the management of land requisition and ensure the needs of construction land, these detailed rules are formulated in accordance with the Land Administration Law of the People's Republic of China and the Measures for the Implementation of the Land Administration Law of the People's Republic of China in Guangdong Province, combined with the actual situation of Duanzhou City.

Article 2 Compensation for land expropriation includes land compensation fee, resettlement fee, young crops compensation fee and ground attachments compensation fee.

Article 3 Compensation for land requisition shall be implemented according to the following standards:

(1) Land compensation fee and resettlement subsidy. Compensation of 600,000-750,000 yuan (40,000-50,000 yuan/mu) per hectare for requisition of cultivated land, garden and aquaculture water surface, of which the resettlement subsidy is 375,000-450,000 yuan (25,000-30,000 yuan/mu); Expropriation of rural collective non-agricultural construction land, village Chigo land and homestead, compensation of 600,000-750,000 yuan per hectare (40,000-50,000 yuan/mu). Requisition of dikes, rivers, wasteland, rural non-agricultural construction land, village land, homestead and other land that is not subject to agricultural tax will not be supplemented with resettlement subsidies after compensation according to the above standards.

(2) Young crops compensation fee. Paddy field compensation is 22,500 yuan per hectare (1.500 yuan/mu); Vegetable compensation is 37,500 yuan per hectare (2,500 yuan/mu); Compensation per hectare for dry land 1.5 million yuan (1.0 million yuan/mu); Fish pond compensation (including lotus pond and dry pond fees) is 37,500 yuan per hectare (2,500 yuan/mu). Other crops shall be compensated according to the verified actual quantity and the planting quantity per unit area determined by the competent agricultural department. Young crops compensation fee is to compensate the existing crops within the scope of land acquisition, and no compensation will be given to the crops on the ground during land acquisition.

(3) Attachment compensation. The attachments and buildings on the ground shall be compensated according to the replacement price promulgated by the national construction administrative department combined with depreciation. Illegal buildings will not be compensated, and the victims must be demolished and relocated unconditionally.

Fourth expropriation of rural collective land, land acquisition compensation by the land administrative departments entrusted land units directly paid to the expropriated rural collective economic organizations.

Article 5 The land compensation fee shall be paid to the ownership unit of the expropriated land in accordance with the regulations for the development of rural economy and collective public welfare undertakings, and shall not be used for other purposes; Compensation for young crops and attachments shall be paid in full to the land contractor or the owner of young crops and attachments. Resettlement subsidies are paid to rural collective economic organizations and managed and used by rural collective economic organizations. Where the resettlement personnel are resettled by other units, the resettlement subsidy shall be paid to the unit responsible for resettlement.

Sixth state-owned farms, fish farms and other state-owned agricultural land recovered by the municipal government shall be implemented in accordance with the compensation standards for collective land expropriation.

Article 7 The government may recover the allocated land use right for free because of public interests or the need of implementing urban planning. When the government recovers the allocated land use right free of charge, it can give appropriate compensation to the buildings and other attachments on the ground according to the actual situation.

Eighth expropriation of rural collective agricultural land, recovery of state-owned agricultural land and other new construction land taxes and fees according to the following standards:

(1) Land compensation fees and resettlement subsidies shall be paid to units and individuals whose land has been expropriated according to the standards determined in Article 3.

(two) land reclamation fees, paddy fields, vegetable fields, dry land per square meter of 20 yuan; Fish ponds and gardens per square meter 10 yuan.

(three) the new construction land use fee per square meter of 24 yuan. It is used by rural collective economic organizations for their own use.

(four) farmland occupation tax, occupying agricultural land per square meter of 8 yuan; Villagers' residential construction occupies agricultural land, 4 yuan per square meter, and 2 yuan per square meter for highway construction.

(5) The land acquisition management fee is charged at 2. 1% of the total land acquisition compensation.

Article 9 For the land requisitioned according to law, the financial department shall stop collecting the agricultural tax on the land from the second year after the approval document for land requisition is issued.

Tenth land compensation and resettlement subsidies for the expropriation of rural collective land outside the scope of urban planning in Duanzhou District shall be calculated according to 50% of the compensation (assistance) fees determined in Article 3 of these Provisions.

Eleventh these rules shall be interpreted by Zhaoqing Municipal Bureau of Land and Resources.

Article 12 These Rules shall come into force as of September 30, 2003. If the relevant documents previously issued by the municipal government conflict with these rules, these rules shall prevail.

Supplementary Provisions on Land Requisition Compensation in Duanzhou Urban Planning Area

In order to further improve the land expropriation in Duanzhou City, according to the Measures of Guangdong Province for Implementing the Land Administration Law of the People's Republic of China and combining with the actual work, we hereby issue the Notice on the Implementation Rules for the Expropriation and Compensation of Land, Young crops, attachments and buildings within the urban planning scope of Duanzhou City (Zhao Fu [2003] No.41).

First, the occupation of construction land compensation standards

(a) the occupation of land obtained by administrative allocation, which belongs to the red line of urban roads, shall not be compensated; For the part actually occupied outside the red line of land withdrawal, compensation shall be made according to the following standards: 1 April, 989 1 For land acquisition before April (excluding April1), compensation shall be made per square meter for commercial land 180 yuan, compensation for residential land 150 yuan and compensation for industrial land/. (two) the occupation of rural collective construction land (self-use land, homestead), in line with the requirements of urban planning, in principle, within the scope of the original collective economic land adjustment. If the land owned by the original collective economic organization cannot be adjusted, it can be replaced in the same amount in different places. If it is indeed difficult to replace the land in different places, compensation shall be made with reference to the preceding paragraph, and the land index for self-use shall no longer be arranged.

(III) To recover the sold state-owned land, according to Article 58 of the Land Administration Law of the People's Republic of China and Article 19 of the Urban Real Estate Administration Law of People's Republic of China (PRC), and referring to the original transfer price agreement, compensation shall be given according to the land use area and land use approved by the land use certificate.

Second, the demolition of buildings and attachments compensation standards

(1) Compensation standard for rural collective economic organizations and villagers' houses that have received land use certificates on collectively owned construction land.

2. If it is impossible to arrange the permanent relocation of the land, 40% of the assessed price of the occupied land shall be deducted from the assessed price of the real estate market in the same area and building type for compensation.

(two) the demolition of temporary buildings within the approved period, according to the building structure, old and new degree, residual value calculation, compensation per square meter of construction area 150 yuan to 200 yuan.

(4) Compensation for other attachments on the ground: 50 yuan per square meter for fences (including retaining walls); Each well is opened 1000 yuan, and each well is not opened in 300 yuan; Cement ground (including lime sand and brick) drying grain field 30 yuan per square meter; Fish pond culverts are 300-500 yuan each, ponds (including fish ponds) are 35 yuan per square meter, brick furnaces are 200 yuan per meter, water pipes are 2 yuan per meter, wire compensation is 2 yuan per meter, cement poles are 100 yuan each, Chinese fir poles are 50 yuan per square meter, and cement facilities drainage ditches and cement hardened roads are 50 yuan per square meter.

(5) For the demolition of graves, 500 yuan shall be compensated for each hole of earth graves, 800 yuan for each hole of brick or cement structures, and 100 yuan for each hole of bone altar.

(six) the use of fill construction land, fill costs per cubic meter 13 yuan compensation.

Third, the young crops compensation standard

(1) compensation for young crops in vegetable fields and fish ponds: 3,000 yuan/mu for vegetable fields and 5,000 yuan/mu for fish ponds. If the construction project needs to hand over the dry pond land in the middle of the year, the compensation fee per mu 1000 yuan can be increased (including the early dry pond fee, fish pond loss and current rent).

(II) Standard planting specifications for young crops: According to the actual planting specifications, the reasonable standards for crop planting in Duanzhou urban area of our city are: banana 140 plants/mu, plantain 130 plants/mu, citrus 80 plants/mu, papaya 200-250 plants/mu, litchi 25-30 plants/mu and longan. The planting standards of other rare seedlings are implemented with reference to the standards formulated by the agricultural department.

(3) Compensation standard for all kinds of young crops: if the crops are planted in reasonable contiguous plots, compensation shall be made according to the above standard of "number of plants per mu" and the following unit price of "compensation standard for all kinds of young crops"; The part beyond reasonable planting shall be compensated according to the relocation fee standard of 1000 yuan per mu.

1, plantain and banana: 1.5 m above each plant 10 yuan, 1.5 m below each plant 5 yuan;

2. Citrus (1 m or more) has fruit per tree 10 yuan, but no fruit per tree has 5 yuan;

3. Papaya: each 25 yuan with fruit income 10 yuan without fruit;

4. Bamboo: small clumps (1below) per clump 15 yuan, large clumps (1 1 above to below 30) per clump of 30 yuan, and large clumps (above 30) per clump of 50 yuan;

5. Metasequoia glyptostroboides:/kloc-22 yuan per plant above 0/0m, 12 yuan per plant below 0/0m, and 5 yuan per plant below 5m;

6. Miscellaneous trees: each plant above 5m 10 yuan, and each plant below 5m/5 yuan;

7. Litchi, guava, mango, wampee, carambola, plum tree, pomelo tree, loquat, ginseng fruit and pineapple tree: every 80 yuan with fruit over 2 meters, and every 20 yuan without fruit under 2 meters;

8, longan, litchi 3 meters above the old tree fruit per 300 yuan, 3 meters below the fruit per tree 100 yuan, no fruit per tree 50 yuan, saplings according to the nursery compensation standard compensation;

9. Other seedlings shall be compensated according to the above standards.

(4) Nursery compensation standard: Nurseries such as citrus, longan, litchi, guava, mango, longan leaf, carambola, wampee, plum tree, loquat, ginseng fruit and pineapple tree (below 1 m) that exceed the above standard planting specifications will be compensated according to the relocation compensation fee of 3,000 yuan per mu; 1 m or more (including green nursery) will be compensated according to the relocation fee of 5000 yuan per mu.

The growers will move the nursery by themselves within one month after receiving the relocation compensation or according to the time agreed by both parties.

(five) compensation standards for seedlings planted sporadically:

Kapok trees 1 and 120 yuan/plant with DBH above 9 cm, and kapok trees 10 yuan/plant 50 yuan with DBH below 3-9 cm;

2. The diameter of trees is more than 9cm, and each tree is 130 yuan; Ground diameter 6-8 cm, each 80 yuan; The ground diameter is 3-5 cm, and each 45 yuan below 3-5cm is 15 yuan;

5. 30 yuan per plant of Lagerstroemia tenuifolia;

For single-plant seedlings with high economic value, compensation shall be given according to the above standards.

Iv. other relevant provisions

(1) Requisition of illegally occupied land or demolition of illegally built houses shall not be compensated. The parties concerned must withdraw from the land and demolish their own houses in accordance with the prescribed demolition period. If the houses and land are not demolished within the time limit, it shall be compulsory according to law.

(II) Compensation for young crops, nurseries, attachments and buildings Since the date of announcement of land acquisition, no compensation will be given to those who compete for seeds and buildings after the date of announcement.

(3) Disputes over compensation and resettlement standards shall be settled through consultation; If negotiation fails, it shall be decided by the people's government that approved the land acquisition.

(four) the provisions of the relevant documents previously issued by the municipal government conflict with these supplementary rules, and the contents of these supplementary rules shall prevail.

(five) the supplementary rules shall be interpreted by the Municipal Bureau of Land and Resources, and shall be implemented as of the date of promulgation.
