According to statistics, as of March 3, 2009, the cumulative number of applications and authorizations for new plant variety rights reached 6348 and 23 12 respectively. The scope of applicants covers 30 provinces, municipalities, autonomous regions and 15 countries in China, and the total number of applications for authorization in Sichuan Province ranks first in the country for six consecutive years. Before 2005, the annual application volume of plant variety rights in China has maintained a growth rate of more than 30%. Since 2004, the annual application volume of plant variety rights in China ranks fourth among UPOV member countries, and the number of effective variety rights ranks before 10 among UPOV member countries. Specifically, the protection of new plant varieties in China has made progress in six aspects. The Ministry of Agriculture and the State Forestry Administration are the examination and approval authorities for the right of new plant varieties in China. According to the division of labor, the two departments are jointly responsible for accepting and reviewing applications for new plant variety rights, and granting new plant variety rights to new plant varieties that meet the prescribed conditions. The Ministry of Agriculture has established 1 testing center and 14 testing sub-center throughout the country. The State Forestry Administration has established 1 testing center, 5 testing sub-centers, 2 molecular testing laboratories and 5 professional testing stations throughout the country. On the basis of drawing lessons from international technical specifications for new plant variety test and combining with China's actual situation, China has formulated 102 guidelines for new plant variety test, among which 18 has been promulgated and implemented according to national or industrial standards. China took the lead in formulating the UPOV test guide for tea plants, camellia, millet, peony and other plants, among which the tea plant test guide (TG/238/ 1) is the first UPOV DUS test guide in China.

After the Ministry of Agriculture released the first batch of new variety protection lists in 1999, it released seven lists as of April 2 1 2008. With the continuous development of China's new plant variety protection system, the number of applications for variety rights from abroad has also increased rapidly. By the end of March 2009, China had accepted 445 applications for variety rights from 15 countries, and granted10/piece. The introduction of foreign excellent varieties has promoted the development of China's agriculture and forestry trade, met the growing diversified life needs of consumers, and promoted the diversification of plant breeding and scientific research investment channels.
