Regulations of Weinan Municipality on Wetland Protection

Chapter I General Provisions Article 1 In order to strengthen the protection and management of wetlands, maintain their ecological functions and biodiversity, and promote the sustainable utilization of wetland resources, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, protection, utilization and management of wetlands within the administrative area of this Municipality. Article 3 Wetlands as mentioned in these Regulations refer to perennial or seasonal moist areas and waters with a certain area and important ecological functions, including natural wetlands such as river wetlands, lake wetlands and swamp wetlands, and artificial wetlands such as reservoirs and ponds. Article 4 Wetland protection shall follow the principles of protection priority, scientific restoration, rational utilization and sustainable development. Fifth city and county (city, district) people's governments shall establish a coordination mechanism for wetland protection, and make overall plans to solve major problems of wetland protection.

The administrative department of forestry of the people's governments of cities and counties (cities, districts) is the administrative department in charge of wetland protection, and is responsible for organizing, coordinating, guiding and supervising the work of wetland protection.

City, county (city, district) development and reform, land and resources, planning, housing construction, agriculture, water, transportation, cultural relics tourism, health, environmental protection and other departments should do a good job in wetland protection in accordance with their duties. Article 6 The forestry administrative departments of cities and counties (cities, districts) shall, jointly with the departments of development and reform, land and resources, planning, housing construction, agriculture, water affairs, transportation, cultural relics tourism and environmental protection, formulate wetland protection plans every five years, and announce them to the public after being approved by the people's government at the same level.

Wetland protection planning shall include the following contents:

(1) Distribution, types and characteristics of wetland resources, water resources and wildlife resources;

(two) the overall requirements, objectives and tasks of wetland protection and utilization;

(three) the scope of wetland protection, protection focus and utilization mode;

(4) Prohibited development and construction areas and restricted development and construction areas;

⑤ Safeguards.

The relevant departments shall solicit the opinions of the forestry administrative departments at the same level when preparing special plans involving wetlands.

Once the wetland protection plan is published, no unit or individual may change it without authorization. Seventh city and county (city, district) people's governments should incorporate wetland protection into the national economic and social development plan, and the required funds should be included in the fiscal budget at the same level. Article 8 The Municipal People's Government shall set up an expert committee on wetland protection.

The expert committee on wetland protection demonstrated and put forward opinions on the compilation of wetland protection planning, the establishment of wetland directory, the delineation of wetland protection scope, the formulation of wetland protection and utilization planning, and the evaluation of wetland resources.

The opinions of the expert committee on wetland protection should be taken as the basis for wetland protection. Ninth city and county (city, district) people's governments and their relevant departments, news media should strengthen the publicity and education of wetland protection, popularize wetland protection laws and regulations and scientific knowledge, and raise public awareness of wetland protection. Tenth units and individuals are encouraged to carry out scientific research on wetland protection. Support citizens, legal persons and other organizations to participate in wetland protection in the form of voluntary service and donation.

City, county (city, district) people's governments shall commend and reward the units and individuals that have made outstanding contributions in wetland protection. Chapter II Protection and Utilization Article 11 Wetlands are divided into national important wetlands, provincial important wetlands, municipal important wetlands, county important wetlands and general wetlands according to the importance of ecological functions and environmental benefits.

The determination and adjustment of national important wetlands and provincial important wetlands shall be carried out in accordance with the relevant provisions of the state and the province.

The determination and adjustment of municipal important wetlands shall be put forward by the municipal forestry administrative department in conjunction with relevant departments and announced after being approved by the Municipal People's government.

The determination and adjustment of important wetlands at the county level shall be put forward by the administrative department of forestry of the county (city, district) jointly with relevant departments, announced after the approval of the people's government of the county (city, district), and reported to the administrative department of forestry of the city for the record.

Wetlands other than important wetlands are general wetlands. Twelfth of the city's national important wetlands, provincial important wetlands, municipal important wetlands, county-level important wetlands and general wetlands to implement directory management.

The administrative department of forestry shall specify the name, type, protection level, scope and boundary of protection, management responsibility unit, etc. Included in the list of wetlands, and set up protection signs. Thirteenth city and county (city, district) people's government can take the establishment of wetland nature reserves, wetland parks, wetland reserves and other ways to protect wetlands.

City, county (city, district) people's governments shall, according to the actual situation of wetlands, take necessary policies, management and technical measures to maintain the natural ecological characteristics of wetlands and prevent the degradation of wetland ecological functions. Article 14 The people's governments of cities and counties (cities, districts) shall apply for the establishment of wetland nature reserves.

The establishment and management of wetland nature reserves shall be implemented in accordance with relevant laws and regulations. Fifteenth typical ecosystem, unique natural landscape, great historical and cultural value, with the significance of popular science publicity and education, and can be used to carry out eco-tourism and other activities, you can establish a wetland park.

Wetland parks are divided into national wetland parks, provincial wetland parks and municipal wetland parks.
