How to judge people poking their eyes?

The decision to blind a person usually depends on the situation:

1. Whoever intentionally blinds others' eyes, which constitutes the crime of intentional injury, shall be punished as intentionally hurting others' bodies and causing serious injuries, and shall be sentenced to fixed-term imprisonment of more than 10 years;

2. Whoever mistakenly blinds others' eyes and causes serious injuries shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention;

3. Mental patients whose perpetrators are under 14 years old or unable to identify or control their own behavior shall not be held criminally responsible;

4. The perpetrator has reached the age of 14 and has been sentenced to fixed-term imprisonment of more than 10 years, life imprisonment or death penalty;

5. If a criminal has surrendered himself, rendered meritorious service or made significant meritorious service, he may be given a lighter or mitigated punishment;

6. If the criminal is over the age of 14 and under the age of 18, he may be given a lighter or mitigated punishment, and the death penalty is not applicable.

Legal basis: Article 234 of the Criminal Law of People's Republic of China (PRC).

Whoever intentionally harms another person's body shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance.

Whoever commits the crime mentioned in the preceding paragraph and causes serious injuries shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes death or serious disability by particularly cruel means shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death. Where there are other provisions in this Law, such provisions shall prevail.
