What is the background and relevant regulations of implementing ex situ development to supplement cultivated land in Guangdong Province?

After the implementation of the Land Management Law of the People's Republic of China, the state strictly implements the system of "one occupation and one supplement" for cultivated land construction. Due to the uneven distribution of cultivated land reserve resources in different parts of the province, Guangdong failed to achieve the goal of balancing cultivated land occupation and compensation in the province for two consecutive years, and was awarded the title of informed criticism by the Ministry of Land and Resources. In order to effectively protect cultivated land and ensure the balance of cultivated land occupation and compensation, Guangdong has carried out the work of developing and supplementing cultivated land ex situ. Ex situ development refers to cities and counties (districts) that lack reserve resources of cultivated land. Due to the large amount of cultivated land occupied by non-agricultural construction, the annual non-agricultural construction projects in this administrative region can not achieve the balance of cultivated land occupation and compensation, so paid measures are taken to entrust areas rich in cultivated land reserve resources to develop supplementary cultivated land on their behalf, so as to make up for it first and then occupy it.

In order to standardize the ex situ development of supplementary cultivated land, the Guangdong Provincial Department of Land and Resources issued the Regulations on the Administration of Ex situ Development of Supplementary Cultivated Land in Guangdong Province (for Trial Implementation) on 200 1 1 according to the Implementation Measures of the Land Administration Law of the People's Republic of China and the Measures for the Administration of Supplementary Cultivated Land in Guangdong Province.

Article 20 of the Measures for the Implementation of the Land Administration Law of the People's Republic of China in Guangdong Province, which was revised and issued in March 2003, stipulates: "Cities and counties that can't cultivate enough cultivated land in this area due to the shortage of land reserve resources must be reported to the land administrative department of the people's government at the next higher level for approval, and cultivated in designated areas, and the land administrative department of the provincial people's government shall jointly with the provincial agricultural administrative department for acceptance."
