The balance index of occupation and compensation is the standard for the Bureau of Land and Resources and the Finance Bureau to calculate the balance cost of cultivated land occupation and compensation according to the agreed area of reclamation and the adjusted price in the current year.

When non-agricultural construction occupies cultivated land, it should supplement the cultivated land area according to the principle of how much it occupies. The basic requirement of the balance system of cultivated land occupation and compensation, any construction occupation of cultivated land must fulfill the obligation of reclaiming cultivated land. The person responsible for reclaiming cultivated land is the unit occupying cultivated land.

After the unified collection of urban construction land, the municipal and county people's governments are responsible for reclamation, and the reclamation costs can be included in the cost of construction land, but the responsibility must be borne by the municipal and county people's governments. The land used for construction projects outside the urban construction area shall be the responsibility of the construction unit that undertakes the obligation of reclaiming cultivated land, and the land administrative departments of the county and municipal people's governments shall be responsible for supervision and acceptance. Village collective economic organizations or villagers' committees are responsible for the occupation of cultivated land in the construction of village towns, and the land management departments of county and municipal people's governments are responsible for supervision and acceptance. Land reclamation funds must be implemented. Reclamation of cultivated land plots should be implemented.

Do not have the reclamation conditions, or the cultivated land does not meet the requirements, the construction unit can pay the reclamation fee in accordance with the relevant provisions, and the land management department of the local government shall fulfill the reclamation obligations. Strictly implement the balance system of cultivated land occupation and compensation, resolutely implement the first occupation and then compensation, and all the land that has not been supplemented will not be submitted for approval, establish and improve the balance account of cultivated land occupation and compensation, and achieve standardized management and complete data.

Land Management Law of the People's Republic of China

Article 3 It is a basic national policy of our country to cherish and make rational use of land and effectively protect cultivated land. People's governments at all levels shall take measures to comprehensively plan, strictly manage, protect and develop land resources and stop illegal occupation of land. Article 4 The State practices a land use control system.

The state formulates the overall land use planning, defines the land use, and divides the land into agricultural land, construction land and unused land. Strictly restrict the conversion of agricultural land into construction land, control the total amount of construction land, and implement special protection for cultivated land.

The agricultural land mentioned in the preceding paragraph refers to the land directly used for agricultural production, including cultivated land, woodland, grassland, farmland water conservancy land and aquaculture water surface. Construction land refers to the land for building buildings and structures, including urban and rural housing and public facilities, industrial and mining land, transportation and water conservancy facilities, tourism land and military facilities; Unused land refers to land other than agricultural land and construction land.

Units and individuals using land must use the land in strict accordance with the purposes determined in the overall land use planning.
