What procedures and materials are needed for marriage registration?

Application, examination and registration are three links in the process of marriage registration.

(1) application

Those who meet the conditions for marriage registration shall bring relevant certification materials and registration photos, apply for marriage registration in person at the marriage registration office where one party's household registration is located, and fill in the Declaration on Application for Marriage Registration and other documents.

The documents and materials for applying for marriage registration depend on individual circumstances. For example, China citizens applying for marriage registration in China (except Hong Kong, Macao and Taiwan) must hold their valid ID card, household registration book, pre-marital inspection certificate, single certificate and declaration of no blood relationship (lineal blood relatives and collateral blood relatives within three generations) and other materials. Those who apply for divorce and remarriage should also carry divorce certificates.

Foreigners applying for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who have settled in China) must hold their valid passports or other identification certificates, nationality certificates, valid residence permits for foreigners, and certificates that can effectively prove their marital status.

(2) Review

The marriage registration office will examine the application of the parties to find out whether the documents and certificates meet the conditions for marriage. If the application materials submitted by the parties are unknown, the marriage registration authority shall ask the parties concerned and may require them to provide corresponding certification materials when necessary.

(3) Registration (Licensing)

The marriage registration authority shall register those who meet the conditions for marriage and issue a marriage certificate; For divorced people, the marriage registration office will generally cancel the divorce certificate; The marriage registration authority shall, at the request of the parties concerned, issue a written statement stating the reasons why the marriage registration cannot be handled.

What procedures and documents do you need for divorce?

The divorce registration process is as follows:

(1) application

If the husband and wife voluntarily divorce in the Mainland, they shall conclude a written divorce agreement and jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:

(2) Accept

Those who do not meet the application conditions will not be accepted, and the parties may request to issue a notice of rejection of the divorce registration application.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and delivers the receipt of the application for divorce registration to the parties concerned, any party who does not want to divorce can submit his identity certificate and the receipt of the application for divorce registration to the marriage registration office that accepts the application for divorce registration (if the receipt cannot be found, the situation can be explained in writing), and fill out the Application for Withdrawal of Divorce Registration according to the regulations. After verification, the marriage registration authority shall issue the Confirmation of Divorce Registration to the parties concerned, and file the Application for Divorce Registration, the Application for Divorce Registration and the Confirmation of Divorce Registration (stubs) together. Within 30 days after the expiration of the cooling-off period for divorce, if both husband and wife who request a divorce fail to apply for a divorce certificate to the marriage registration authority, it shall be deemed that both parties are unwilling to divorce and withdraw their application for divorce registration.

(4) Review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period expires is a holiday, the date of the cooling-off period expires is the first day after the holiday), both parties shall apply to the marriage registration authority for the issuance of divorce certificates with photos, marriage certificates, ID cards or passports, divorce agreements and other relevant documents and materials stipulated in the Marriage Registration Standards. The marriage registration authority shall conduct the examination in accordance with the relevant procedures and conditions. If the divorce registration conditions are not met, the divorce registration shall not be granted, and if necessary, a notice of divorce registration shall be issued according to the requirements of the parties.

(5) Registration and certification
