Regulations of Ningxia Hui Autonomous Region on the Promotion of Lycium barbarum Industry (revised on 20 19)

Chapter I General Provisions Article 1 In order to promote the sustained and healthy development of Lycium barbarum industry, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of the autonomous region. Article 2 These Regulations shall apply to the personnel engaged in the cultivation, processing, management and related services of Lycium barbarum within the administrative area of the autonomous region. Article 3 The development of Lycium barbarum industry should adhere to the principles of unified planning, green development, industrial standardization, quality supervision and brand protection. Article 4 The people's governments of cities and counties (cities, districts) in autonomous regions and Lycium barbarum producing areas shall incorporate the development of Lycium barbarum industry into the overall plan of national economic and social development, and establish and improve the coordination mechanism for promoting the development of Lycium barbarum industry.

The forestry grassland (Lycium barbarum) management department of the people's governments at or above the county level shall be responsible for the management of Lycium barbarum industry within their respective administrative areas.

Agricultural and rural areas, natural resources, ecological environment, industry and information technology, commerce, market supervision and management and other relevant departments shall, according to their respective responsibilities, do a good job in the development of Lycium barbarum industry according to law.

The Lycium barbarum Industry Association shall play a service and coordination role and provide services for Lycium barbarum producers and operators according to law. Chapter II Planning and Support Article 5 The People's Government of the Autonomous Region shall formulate a plan for the development of Lycium barbarum industry.

The people's governments of cities and counties (cities, districts) with districts in Lycium barbarum producing areas may formulate plans for the development of Lycium barbarum industry according to local conditions.

The development plan of Lycium barbarum industry should be connected with the strategic planning of spatial development, the overall planning of land use and the planning of ecological environment protection in the autonomous region. Article 6 The people's government of the autonomous region shall increase the capital investment in the development of Lycium barbarum industry, giving priority to the protection of Lycium barbarum germplasm resources, the breeding and promotion of new varieties, the innovation of key technologies, the environmental protection of production areas, the cultivation of talents, the construction of quality monitoring system and information platform, and the promotion of Lycium barbarum culture. Article 7 The people's governments of cities and counties (cities, districts) in autonomous regions and Lycium barbarum producing areas shall formulate preferential policies for the development of Lycium barbarum industry and strengthen the construction of infrastructure such as Lycium barbarum planting bases, roads in industrial parks, water conservancy and electric power. Article 8 The people's government of the autonomous region shall include the Lycium barbarum production and processing machinery and equipment identified at the autonomous region level in the catalogue of agricultural machinery products supported and promoted. Enterprises or individuals who purchase agricultural machinery and equipment in the product catalogue shall be given policy subsidies in accordance with relevant regulations. Article 9 The people's government of the autonomous region and the people's governments of cities and counties (cities, districts) with districts in Lycium barbarum producing areas shall encourage and support scientific research institutes, institutions of higher learning and Lycium barbarum production and processing enterprises to jointly establish scientific and technological innovation and achievement transformation mechanisms, and carry out research and development and popularization of technologies such as Lycium barbarum breeding, advanced farming and cultivation, new machinery and equipment, and deep processing of products.

Lycium barbarum production and processing enterprises that produce food and beverage, biopharmaceuticals, health care, cosmetics and other deeply processed products of Lycium barbarum enjoy preferential policies in accordance with relevant regulations. Article 10 The administrative department of Lycium barbarum industry of the people's government of the autonomous region and the people's governments of cities and counties (cities, districts) with districts in Lycium barbarum producing areas shall, jointly with relevant departments, strengthen the construction of professional teams in Lycium barbarum industry, and introduce and train professional and technical personnel such as planting, processing, R&D and identification of Lycium barbarum. Eleventh encourage financial institutions to develop financial products and services suitable for the development of Lycium barbarum industry, and give credit support to Lycium barbarum industrial projects.

Encourage and support Lycium barbarum production and processing enterprises to raise funds in various ways to enhance their development capabilities.

Encourage and support Lycium barbarum planting enterprises and individuals to participate in planting insurance, and the insurance premium can be subsidized by the local finance of the people's government at or above the county level. Article 12 Enterprises and individuals contracted to develop barren hills, gullies, hills and beaches for planting Lycium barbarum may apply to the real estate registration agency of the local people's government at the county level for real estate registration of forest and woodland. Thirteenth encourage and support the development of Lycium barbarum industrial culture, strengthen the protection of traditional processing technology and cultural heritage of Lycium barbarum, excavate, sort out and spread Lycium barbarum culture, and promote the integrated development of Lycium barbarum culture and Lycium barbarum industry. Chapter III Protection of Origin Article 14 People's governments at the county level in Lycium barbarum producing areas may delimit the scope of protection in areas where Lycium barbarum cultivation is concentrated and implement the protection of origin.

The designated place of origin of Lycium barbarum should be registered and publicized to the public. Fifteenth it is forbidden to occupy or damage the infrastructure within the scope of protection of the origin of Lycium barbarum.

If the project construction affects the normal use of infrastructure functions within the scope of Lycium barbarum protection, the construction unit shall take corresponding protective measures and restore it to its original state at the end of the construction. Article 16 It is forbidden to discharge, pile up or dispose of wastes within the protection scope of Lycium barbarum producing areas.

It is forbidden to build new projects that pollute soil, water quality and atmosphere within three kilometers around the protection scope of Lycium barbarum origin. Completed pollution projects should be rectified or relocated within a time limit according to law. Seventeenth expropriation of land within the scope of protection of the origin of Lycium barbarum, should implement the balance of occupation and compensation, and stabilize the planting area of Lycium barbarum.

Zhongning county is the core producing area of Lycium barbarum in Ningxia, and the planting area of Lycium barbarum in the core producing area is protected. Chapter IV Quality Supervision Article 18 The administrative departments of agriculture, rural areas, forestry and grassland (Lycium barbarum) of the people's government of the autonomous region and the people's governments of cities and counties (districts) in Lycium barbarum producing areas shall, in accordance with their duties, strengthen the technical guidance of Lycium barbarum planting and the supervision and management of the use of pesticides, fertilizers and other inputs, promote the use of efficient organic fertilizers, plant sources, microbial sources and pesticides with high efficiency, low toxicity and low residue, popularize integrated pest control technologies, and promote unified pest control.
