Can I borrow the car or not?

According to Article 49 of China's Tort Liability Law: "If the owner and user of a motor vehicle are not the same person due to reasons such as leasing or borrowing, after a traffic accident, if one of the motor vehicles is responsible, the insurance company shall make compensation within the limits of motor vehicle compulsory insurance liability.

For the insufficient part, the motor vehicle user shall be liable for compensation, and if the motor vehicle owner is at fault for the damage, he shall be liable for compensation accordingly. Only if the owner is at fault for the occurrence of the damage will he bear the corresponding liability for compensation, not joint liability. If there is no fault, it will not be liable for compensation.

Matters needing attention of auto lenders

It should be noted that the lender must ensure that the performance of the lent vehicle is in good condition and there are no defects. If the lender knows or should know that the defects of the vehicle affect safe driving, it shall be deemed that the lender is at fault.

When lending a vehicle, the lender shall lend the vehicle to a person who holds a driver's license that is consistent with the quasi-driving model of the lent vehicle. If the borrower is not qualified to drive, then whether the lender knows it or not, it should be deemed to be at fault.
