Interim Provisions of Heilongjiang Province on Banning Witch Activities

Article 1 In order to strengthen the construction of socialist spiritual civilization, maintain social order, protect the safety of people's lives and property, and prohibit feudal superstitious activities such as gods and witches, these Provisions are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this province. Article 2 Any feudal superstitious activities such as fortune-telling, divination, smoking stickers, seeing houses of Yin and Yang, seeking immortals and worshipping gods, seeking medical treatment, playing tricks, exorcising demons and exorcising evil spirits are carried out in this province. And using feudal superstition to spread rumors and mislead people, which are not serious enough for criminal punishment, shall be punished in accordance with these provisions.

Except for normal religious activities permitted by law. Article 3 Public security organs at all levels shall be responsible for investigating and banning activities of ghosts and gods. Article 4 Whoever commits one of the following acts shall be detained for not more than 15 days, fined not more than 200 yuan or given a warning.

(1) playing tricks on the masses;

(two) the use of feudal superstition to treat the masses;

(3) To provide conditions for the activities of witches;

(four) fortune telling, fortune telling, fortune telling and fortune telling by fortune telling;

(5) demonizing or exorcising evil spirits;

(six) check the Yin and Yang homestead;

(seven) carrying out feudal superstitious activities, causing minor injuries; Article 5 Anyone who commits one of the following acts shall be given reeducation through labor.

(a) using feudal superstition to create and spread rumors and confuse the masses;

(2) engaging in the activities of ghosts and gods, if the circumstances are serious, but not serious enough for criminal punishment;

(three) to provide conditions for the activities of witches, and the circumstances are serious;

(4) inciting the masses to seek elixir of life;

(five) using feudal superstitious activities to indecently and insult women;

(six) fortune-telling, fortune-telling, fortune-telling, and seeing Yin and Yang's house after punishment;

(seven) carrying out feudal superstitious activities, causing harm to others. Sixth in violation of the provisions, one of the following acts, be given a lighter or exempted from punishment.

(a) to participate in the activities of gods and witches for the first time;

(2) Being coerced or deceived by others;

(3) voluntarily admitting the illegal act and being able to correct it;

(four) take the initiative to report others; Seventh in violation of the provisions of any of the following acts, shall be given a heavier punishment.

(a) Carrying out the activities of gods and witches, resulting in consequences;

(2) instigating, coercing or tricking others into engaging in supernatural activities;

(3) taking revenge on informants and witnesses; Article 8 The tools used in feudal superstitious activities and the property defrauded shall be confiscated.

Confiscated property shall be handed over to the local financial department, and the confiscated superstitious tools shall be uniformly handled by the public security organs. Article 9 The penalty adjudication procedure shall be implemented in accordance with Chapter IV of the Regulations of the People's Republic of China on Administrative Penalties for Public Security. Tenth violation of these provisions constitutes a crime, criminal responsibility shall be investigated by judicial organs according to law. Eleventh these Provisions shall be interpreted by the Heilongjiang Provincial Public Security Department. Article 12 Where these provisions conflict with the provisions of the state, the provisions of the state shall prevail. The previous relevant provisions of this province are inconsistent with these provisions. Thirteenth these Provisions shall come into force as of the date of promulgation.
