Violations are divided into serious violations and general violations, which are deducted, accumulated and executed respectively.

General violations accumulated 12 points, blocked 12 days.

The same is true for serious violations, but if you accumulate 48 points within one year, you will be permanently suspended.

Chapter IV Violation of Taobao Rules

Section 1 Handling of Violation

Forty-fourth illegal acts refer to acts suspected of harming the legitimate rights and interests of consumers, operators or Taobao, as well as acts suspected of violating national laws and regulations.

If any member violates the rules, the violations will be corrected, and a certain score will be deducted and published for three days. Violation points will be cleared at 24: 00 every year1February 3 1 day.

Violations are divided into serious violations and general violations, which are deducted, accumulated and executed respectively.

Forty-fifth members to correct violations refers to:

(1) Where prohibited information is posted, Taobao will delete the prohibited goods or information posted by members;

(2) If intellectual property rights are infringed, Taobao will delete the goods or information infringing intellectual property rights released by its members;

(3) If someone else's account is stolen, Taobao will recover the stolen account and make the original owner get the account back through the account appeal process;

(4) If other people's information is leaked, Taobao will delete other people's private information leaked by members;

(five) to defraud other people's property, Taobao deleted the goods or information used to defraud other people's property;

(6) If there is spamming information, Taobao will delete the products or information spammed by members, or seal up the sub-stores with low credit rating in repeated stores;

(7) For false transactions, if 96 points are deducted, or 48 points are deducted, or 24 points are deducted, and the credit ratio of virtual transactions exceeds 34%, Taobao will delete all credit points of members and remove all goods from the store; If 24 points are deducted, but the virtual transaction credit accounts for less than 34%, Taobao will delete the members' false transaction credit points and double other credit points, and remove all goods from the store;

(eight) in violation of the promise, the seller shall repay the compensation agreed upon in the delay in delivery, and perform the obligation of truthfully explaining or the payment, return, replacement and maintenance services agreed upon in the consumer rights protection service; Or the seller must provide invoices to the buyer or Taobao according to the actual transaction price;

(nine) malicious evaluation, Taobao or the evaluator deletes the illegal evaluation;

(10) If the registration is improper, Taobao will seal up a large number of registered accounts or sellers through software and procedures, and publicize and update the real-name authentication information.

Forty-sixth serious violations refer to acts that seriously undermine Taobao's business order and are suspected of violating national laws and regulations.

(1) Members who have accumulated 12 points for serious violations will be punished by closing stores, restricting delivery of goods, restricting sending letters in the station, restricting community functions and publicizing warnings for seven days;

(2) If members have accumulated 24 points for serious violations, they will be punished by closing stores, restricting the release of goods, restricting the sending of letters in the station, restricting community functions, and publicizing warnings 14 days;

(3) If a member has accumulated 36 points for serious violation of regulations, he shall be punished by closing the store, restricting sending letters in the station, restricting community functions and giving a public warning of 2 1 day;

(four) the members who have accumulated 48 points for serious violations shall be punished by sealing up their accounts.

If the amount of a member's single violation penalty is large, resulting in the cumulative penalty meeting the penalty conditions of multiple nodes, or similar node penalties need to be implemented during the penalty period, only the heaviest node penalty will be implemented.

Article 47 A general illegal act refers to an illegal act other than a serious illegal act. For general violations, every 12 points will be deducted, that is, the member will be punished by the store for blocking, restricting the delivery of goods and publicizing a warning 12 days.

If the member is deducted for malicious evaluation or bidding not to buy, the penalty of restricting the buyer's behavior will be added to the subsequent node punishment.

Article 48 A member punished by the enforcement node can only return to normal status after all his violations have been corrected, the punishment period has expired and he has passed the rule assessment.

Section 2 Serious illegal acts

Article 49 The prohibition of information release means that members release commodities or information prohibited by the following national laws and regulations:

(a) release the following goods or information, 48 points each time:

1, firearms, ammunition, ammunition or related equipment, accessories and imitations;

2. Flammable and explosive articles or related chemicals used for manufacturing inflammable and explosive articles;

3. Drugs, narcotic drugs, raw materials, chemicals, addictive drugs, smoking tools and accessories;

4. Books, audio-visual products, videos, documents and materials that are reactionary, undermine national unity, sovereignty and territorial integrity, undermine social stability, involve state secrets, disrupt social order, promote cults and superstitions, promote religious and racial discrimination, or are prohibited from being published and distributed by relevant laws and regulations;

5. Human organs and remains;

6. Software and equipment used to steal others' privacy or secrets;

7. Renminbi in circulation, forged or altered currency and printing equipment;

8, anesthesia injection gun and related products;

9, smuggling, theft, robbery and other illegal income;

10, chemicals for internal or external use that can temporarily make others lose their resistance and have vague consciousness, as well as commodities and information containing yellow and obscene contents;

1 1, cultural relics are suspected of violating the relevant provisions of the Law of People's Republic of China (PRC) on the Protection of Cultural Relics.

(two) release the following goods or information, each deduction 12 points:

1, crowbars, crossbows, darts and other controlled knives and devices that may be used to endanger the personal safety of others;

3. Forge or alter the documents, certificates and official seals of government organs or services that can only be provided by state organs or specific institutions;

6. Available invoices, other bills that can be used for reimbursement and services for issuing such bills;

7. Psychotropic drugs, narcotic drugs, toxic drugs and radioactive drugs;

8. Powder and liquid female aphrodisiac products;

9. The state protects animals' living bodies, limbs, fur, specimens, organs and their finished products, and extinct animals and fossils protected by the state at or above the second level;

10, ID card and ID card verification equipment;

1 1. Hacking software, tutorials and books that may be used to infringe others' information.

(three) release the following goods or information, six points each time:

1, acceptable securities, government-issued coupons and corresponding purchase and recommendation services;

2. Military uniforms, signs and special articles for military and police;

3. Related commodities or information with religious and racial discrimination;

4. Toxic chemicals, pesticides and related information;

5. Tobacco monopoly products;

6. Comics, books, games, audio-visual products containing pornographic violence and vulgar content, as well as pornographic and vulgar goods or information such as SM appliances, adult website accounts and invitation codes, second-hand underwear factories, chats and visiting services;

7. Drugs, blood products or medical devices used for the prevention and treatment of human diseases;

8. Personal privacy information and enterprise internal data;

9, the state protects plants and their products;

10, all kinds of SMS sending equipment and software;

1 1. Unlocking tools, unlocking services and related tutorials and books.

(four) release the following goods or information, 2 points each time:

1, which may be used for goods to avoid traffic management and services to assemble and modify cars;

2. Unauthorized fundraising goods;

3. Books, audio-visual products that are released to the public without permission, such as the answers to official national examinations;

4. Bank card with bank account information at the time of issuance;

5. Illegal network services, such as illegal software or password cracking and retrieval;

6, special wine, military wine, homemade wine;

7. Forge or alter digital goods for brand-new sales;

8. Cosmetics and health care products containing poppy seeds, foods and toys with serious quality problems, expired foods or health care products with promised curative effects, and finished products such as foods, condiments, cosmetics and skin care products containing poppy seeds have been recognized, investigated or recalled by the authorities;

9. Methods and books for making drugs, inflammable and explosive articles;

10, using telephone lines to feed DC for lighting;

1 1, philatelic products prohibited by the state, philatelic products produced without the approval of the postal industry management department, and philatelic products containing the words "Republic of China" issued after 1949;

12, feudal superstitious services such as fortune telling, crossing over, geomantic omen and spiritual practice;

13, one card with multiple numbers, number burning service, and mobile phone card stickers with cracking function;

14, lottery tickets, air tickets and related services released without permission;

15, online games related to plug-ins and private servers.

Article 50 Infringement of intellectual property rights refers to the following acts of users suspected of violating the Trademark Law, Copyright Law, Patent Law and other relevant laws and regulations:

(1) If there is definite evidence to prove that the seller sells counterfeit goods and the circumstances are serious, 48 points will be deducted each time;

(2) If there is definite evidence to prove that the seller sells counterfeit goods, 12 points will be deducted each time;

(3) If the same seller is complained by the same obligee within three days that the commodities, information, store names and member names published or used by him are suspected of infringing his trademark rights, copyrights and patent rights, it shall be regarded as a complaint. If the complaint is established, four points will be deducted each time.

Article 51 Embezzlement of another person's account refers to the act of embezzling another person's Taobao account or Alipay account, which is suspected of infringing on another person's property rights. Those who embezzle other people's accounts will be deducted 48 points each time.

Fifty-second disclosure of other people's information refers to the act of publishing and disseminating other people's private information without permission, which is suspected of infringing on other people's privacy. Those who disclose other people's information will be deducted six points each time.

Article 53 Cheating others' property refers to the act of illegally obtaining others' property for the purpose of making illegal profits, which is suspected of infringing others' property rights. Those who cheat others of their property will be deducted 48 points each time.

Section 3 General illegal acts

Article 54 Spam refers to the behavior that users fail to publish commodities or information in accordance with the requirements of these Rules, which hinders buyers' rights and interests in efficient shopping.

(a) release the following goods or information, each deduction 12 points:

1, Taobao dolls, Taobao gold coins, word-of-mouth cards, accounts of various services provided by Alibaba and its subsidiaries, and software that imitates Alibaba Cloud products;

2. Shark's fin, bear gall and its products;

3, unlimited time and traffic, time can not query and call vulnerability cards, group cards, internal cards, test cards;

4. Online accounts that cannot be queried in time and death insurance accounts of Tencent QQ service;

5. Secondkill device and related software equipment to improve the probability of success;

6. Write papers and exam-related services;

7. Legal consultation, psychological consultation, financial consultation and online consultation services for doctors;

8. You can't inquire about the call charges returned by installments.

(2) Publish the following commodities or information on the commodity page, and deduct 0.3 points for each; Published in the store decoration area or Taobao portal page, deducted four points each time:

1, the released quantity of idle and recycled goods exceeds the limit;

2. Personal mobile phone positioning, bill inquiry and bank account inquiry;

3. Temporary suspension of driver's license scoring service;

4. Alipay's visa-free instant arrival interface;

5. Acceptable foreign trade documents and services for customs declaration, list, commodity inspection and documentation procedures;

6. Commodities or information released for trading purposes;

7. Adult articles, insurance services, books, alcohol, tourist goods and related services released without permission;

8, express, implied with treatment, health care or a nutritional function of food, or personal experience to promote food;

9. Post office parcel list and EMS delivery list;

10, a large number of foreign currencies circulate;

1 1, mobile phone direct dial card and direct dial service, telephone callback card and callback service;

12, hype blog popularity, hype website popularity, and vote for goods or information.

If the seller publishes other goods or information that violates public order and good customs except the above circumstances, Taobao can temporarily remove the goods or information.

(three) the following improper ways to publish goods or information, in addition to the third six points each time, each kind of goods or information deducted 0.2 points:

1, publish advertising information in portals, communities, TaoJianghu, Taobao inquiry and other places where it is forbidden to publish commodity information;

2. Two or more pieces of the same commodity are sold in the store at the same time;

3. Open two or more stores selling the same goods.

(4) Publish the following commodities or information with incorrect descriptions on the commodity page, and each item will be deducted 0.2 points; Published in the store decoration area or Taobao portal page, deducted four points each time:

1. The title and main picture are missing in the commodity information, or there is obvious mismatch between the title, main picture, physical picture, price, logistics mode, postage, after-sales service and other commodity elements;

2, the name of the goods and other information is false or has nothing to do with the goods;

3. The goods are inconsistent with the published categories or attributes;

4. Use false credit rating marks or preferential rating marks.

(5) Except for the following commodities, before the buyer pays and the commodity information shows that there is enough stock, if the seller indicates that the goods cannot be delivered for any reason within 72 hours, 2 points will be deducted each time.

1, Taobao travel channel and special air tickets, ticket tours, hotels and inns;

2. Customize and pre-sell goods;

3, electric city refrigerators, air conditioners, washing machines, LCD TVs, range hoods, gas stoves, disinfection cabinets and other commodities.

Article 55 False trading refers to the act of improving the credit of an account by improper means, which damages the buyer's rights and interests in efficient shopping. If both parties make false transactions, they shall be punished in the following ways:

(1) If the credit generated by false transactions accounts for more than 80% of the account credit, and the number of false transactions exceeds 96 times, 96 points will be deducted each time;

(2) If the credit generated by false transactions accounts for more than 50% and less than 80% of the account credit and the number of false transactions exceeds 48 times, 48 points will be deducted each time;

(three) other false transactions, each deduction of twenty-four points.

Article 56 Delayed delivery means that the seller indicates that the goods cannot be delivered immediately or the buyer fails to deliver the goods within 72 hours after payment, except for the following goods, which hinders the buyer's right to shop efficiently. If the seller delays the delivery, three points will be deducted each time, and at the same time, the seller will compensate the buyer for 5% of the actual transaction amount of the goods, but the maximum amount shall not exceed 30 yuan:

(1) Taobao travel channel and special air tickets, ticket tours, hotels and inns;

(2) Customization and pre-sale of commodities;

(3) Appliances such as refrigerators, air conditioners, washing machines, LCD TVs, range hoods, gas cookers and disinfection cabinets.

The seller's delivery time is subject to the time recorded by the courier company system.

Article 57 Inconsistency in description refers to the behavior that when the transaction is concluded, the goods received by the buyer are inconsistent with the description of the goods by the seller, and the seller fails to disclose the information that must be explained, such as the defects, shelf life and accessories of the goods, which hinders the buyer from being satisfied with the rights and interests of the goods. If the seller's description is inconsistent, three points will be deducted each time.

Article 58 A breach of contract means that the seller fails to provide the following services to the buyer as promised, which hinders the buyer's right to service satisfaction:

(1) After Taobao's judgment, if the seller fails to perform the compensation stipulated in the delayed delivery, the obligation of truthful description or the compensation, return, replacement and maintenance services stipulated in the consumer rights protection service, and the seller in the trial center refuses to provide the trial goods as promised, 12 points will be deducted each time;

(2) Except for refusing to provide the trial goods as promised, if the seller fails to complete the delivery within the time required by relevant services, fails to provide invoices as required, requires the buyer to pay extra fees when providing invoices, fails to use Alipay transactions, fails to use specific payment methods as promised or fails to conduct transactions at the promised price, six points will be deducted each time;

(3) If the seller fails to fulfill other commitments, four points will be deducted each time.

Article 59 "non-auction purchase" refers to the behavior of a bidder who refuses to buy the goods according to his final bid after winning the bid, which hinders the rights and interests of the seller. If the buyer does not bid, it will be deducted 12 points each time, and it must compensate the seller for 5% of the amount of the last bid.

Article 60 Malicious evaluation refers to the behavior of buyers, competitors and other evaluators who seek extra property or other illegitimate interests by giving medium and bad reviews. If the evaluator makes malicious comments, 12 points will be deducted each time.

Sixty-first improper registration refers to the behavior that users register a large number of Taobao accounts through software, programs and other means, which hinders the operation order of Taobao. If a member is improperly registered, 12 points will be deducted each time.

Article 62 Failure to disclose or update the business license information according to law means that the seller who passed the enterprise authentication in Alipay's real-name authentication failed to disclose or update its business license information in time within the time limit specified by Taobao. If the seller fails to open or update the store within fifteen days from the date of opening the store, two points will be deducted each time; If the seller fails to disclose or update within 15 days after the expiration of the above period, 12 points will be deducted each time.

Chapter V Implementation

Section 1 Execution of Transactions

Article 63 If the refund application initiated by the buyer is not completed within three days, you can ask Taobao to intervene. Taobao was processed within seven working days after the intervention.

Article 64 After the transaction is successful, if the buyer finds that the seller's description is inconsistent or violates the promise, he can ask Taobao to intervene at any time within 15 days. Taobao was processed within seven working days after the intervention.

Section 2 Violation of Law Enforcement

Sixty-fifth users' violations are found through complaints from Taobao members and obligees or Taobao investigations.

Sixty-sixth complaints about violations, except spam, false transactions, improper registration, publication of prohibited information, infringement of intellectual property rights, misappropriation of other people's accounts, disclosure of other people's information can be submitted at any time, the rest must be complained within the following specified time; If a complaint is not filed within the specified time, it will not be accepted:

(1) The time for complaining about delayed delivery is within 15 days after the transaction;

(two) the time for the bidder not to buy the complaint is within fifteen days after the buyer takes the photo;

(3) The time for complaining about inconsistent description, malicious evaluation and defrauding others' property is within 15 days after the successful transaction.

Article 67 the respondent shall submit evidence within five days from the date of being complained of illegal acts such as late delivery, failure to purchase by auction, and malicious evaluation. If no evidence is submitted within five days, Taobao has the right to judge and deal with it according to the situation at that time. Taobao will immediately judge and deal with other violations after receiving complaints.

Article 68 Taobao does not accept the seller's own promises or explanations that are contrary to these rules. Except in the case of wrong evidence or wrong judgment, the punishment for illegal acts shall not be suspended or revoked.
