In our daily life, we often see things like "complaints" and "lawsuits". "Litigation" is a folk idiom for litigation, which can be divided into three types according to the law:

One is called criminal proceedings, which is also criminal proceedings. When a person commits a crime, it is often investigated by the public security bureau, prosecuted by the procuratorate and decided by the court. The procuratorate is the prosecutor and the criminal is the defendant.

The second kind is called civil litigation, which is also called civil litigation. Often, the parties to the dispute or the people whose rights and interests are infringed directly go to the court to complain, and the court hears the judgment, and the public security organs and procuratorial organs generally do not participate in the handling. Those who bring a lawsuit directly to the court are called plaintiffs, and the other party is called defendants.

In civil litigation, the plaintiff is not necessarily reasonable, and the defendant is not necessarily unreasonable. Only after the court hearing can we know whether the plaintiff's prosecution is correct. If the plaintiff sues wrongly or the responsibility lies with the plaintiff, the plaintiff will lose the case.

The third is administrative litigation, also called administrative litigation. The characteristic of this kind of lawsuit is that it can only happen when the state administrative organ makes a specific administrative act against a specific person or fact, and the defendant can only be the state organ that makes the specific act. Therefore, administrative litigation is a lawsuit of "people suing officials" and must be carried out in accordance with certain laws. The law that stipulates how to go to court is called "procedural law". There are three procedural laws in China, namely, the Criminal Procedure Law, the Civil Procedure Law and the Administrative Procedure Law.
