Chapter V Legal Responsibility of Regulations on the Administration of Urban and Rural Fair Trade Markets in Anhui Province

Thirty-second acts in violation of these regulations shall be handled by the administrative department for industry and commerce in accordance with the provisions of these regulations; Where laws and administrative regulations provide otherwise, such provisions shall prevail.

Thirty-third illegal occupation, destruction of bazaars venues, facilities or other property, shall be ordered to make corrections, compensation for losses, and impose a fine of 1000 yuan.

Thirty-fourth in violation of the provisions of the provisions of article seventeenth, the sale of prohibited items, shall be punished by the relevant departments in accordance with relevant laws and regulations.

Article 35 Whoever commits the act mentioned in Item 1 of Article 19 of these Regulations shall have his illegal articles and illegal income confiscated, and be fined between one and five times the illegal income; Those who commit the second and third acts shall have their illegal income confiscated and be fined between one and three times the illegal income; Whoever commits the fourth act shall be ordered to make up the vacancy, and the measuring instruments and all illegal income shall be confiscated, and a fine of 500 to 2000 yuan may be imposed; Whoever commits the fifth act shall be ordered to stop the illegal act. For fortune-telling and other acts, the illegal income shall be confiscated and a fine of 1 times but not more than 5 times shall be imposed. Gambling shall be punished by the public security organ in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security.

If the above-mentioned illegal acts are serious enough to require other punishments, they shall be implemented in accordance with relevant laws and regulations.

Thirty-sixth in violation of the provisions of article eighteenth, article thirty, article thirty-one, arbitrary price increases, arbitrary charges, investigated and dealt with by the price department according to law.

Article 37 The confiscation of illegal income and fines shall be carried out in accordance with the provisions of the Administrative Punishment Law of the People's Republic of China.

Thirty-eighth if a party refuses to accept the decision on administrative punishment, it may apply for reconsideration or bring an administrative lawsuit according to law; If it fails to apply for reconsideration, bring a lawsuit or perform the punishment decision within the time limit, the administrative department that made the punishment decision may apply to the people's court for compulsory execution according to law.

Article 39 Whoever refuses or hinders the staff of the administrative department for industry and commerce and other law enforcement departments from performing their official duties according to law shall be punished by the public security department in accordance with the regulations on administrative penalties for public security; Obstructing administrative law enforcement personnel from performing official duties according to law by violence or threat constitutes a crime, and criminal responsibility shall be investigated by judicial organs according to law.

Article 40 Where the market supervisors and managers commit any of the following acts, they shall be criticized and educated by their units or the competent department at a higher level. If the circumstances are serious, they shall be given administrative sanctions. If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law:

(1) Failing to stop or punish acts in violation of these Regulations;

(two) in violation of the provisions of article seventeenth, article nineteenth of the act is not promptly investigated;

(3) Violating the provisions of Article 28.

Market supervision and management personnel who fail to perform their duties or abuse their powers, thus causing economic losses to the parties concerned, shall make compensation according to law.
