How long does it take to get a real estate license?

Handling the real estate license shall be subject to the delivery time agreed in the purchase contract. After 90 days of delivery, you can go to the developer to get the information, and then go to the real estate bureau to apply. The process of handling the real estate license is as follows:

1. Confirm that the developer has registered initially.

Initial registration of developers is the premise of handling real estate licenses. Real estate development enterprises shall, within 60 days from the date of delivery of commercial housing, submit the materials required for the registration of house ownership to the real estate administrative department where the house is located. Usually, it takes about 20 to 60 days for the competent department to handle the initial registration. So two or three months after repossession, you can ask the developer about the initial registration, or you can go to the local real estate transaction information website to inquire. In order to ensure their own interests, the purchase contract should stipulate the time limit for the developer to handle the initial registration, especially the time limit for the developer to handle the initial registration and the "timely notification obligation" after the registration is completed, and clarify the liability for compensation;

Because the surveying and mapping table is an important basis for the registration department to determine the area marked on the real estate license, you can apply for the surveying and mapping table at the housing area metering station designated by the developer, or you can directly get it from the developer with your ID card, or you can apply to the registration department for surveying and mapping the housing area;

4. Get relevant documents

It needs to be clear which necessary application documents need to be obtained and completed at one time. Including the purchase contract, the house settlement form, the copy of the big house property certificate, etc. The completed application form needs to be reviewed and sealed by the developer;

5. Pay the public maintenance fund and deed tax.

The public maintenance fund is generally collected by the community office in the area where the property is located. In some cities, public maintenance funds have been collected by banks, and the payment method can be asked by the staff of the developer.

6. Submit application materials, mainly including the following contents:

(1) sealed application form;

(2) Housing sales contract;

(3) Confirmation letters of the buyers and sellers who signed the pre-sale contract on the house number, the measured area of the house and the settlement of the house price;

(4) Surveying and mapping table, house registration form and household registration book in duplicate;

(5) Special receipts for special maintenance funds;

(6) deed tax payment or tax exemption certificate;

(7) the identity certificate of the buyer (copy of the original inspection);

(8) Submitting a common agreement on house ownership;

(9) Proof of advance payment from the bank.

7. Get the real estate license according to the specified time.

Legal basis: Article 61 of People's Republic of China (PRC) Urban Real Estate Management Law.

Whoever obtains the land use right by allocation or allocation shall apply to the land administration department of the local people's government at or above the county level for registration, which shall be verified by the land administration department of the local people's government at or above the county level, and the land use right certificate shall be issued by the people's government at the same level.

If a house is built on the land for real estate development obtained according to law, it shall apply to the real estate management department of the local people's government at or above the county level for registration with the certificate of land use right, and the real estate management department of the local people's government at or above the county level shall verify and issue the certificate of ownership of the house.

When real estate is transferred or changed, it shall apply to the real estate management department of the local people's government at or above the county level for registration of change of real estate, and apply to the land management department of the people's government at the same level for registration of change of land use right on the basis of the changed house ownership certificate. After verification by the land administration department of the people's government at the same level, the land use right certificate shall be replaced or changed by the people's government at the same level.

If it is otherwise provided by law, it shall be handled in accordance with the provisions of relevant laws.
