Fortune Telling Collection - Comprehensive fortune-telling - Stay in the detention center for at least a few days.

Stay in the detention center for at least a few days.

Detention for at least one day can be divided into three situations:

1. Administrative detention lasts at least one day, usually 15 days. Administrative detention refers to the most severe punishment given to general illegal acts that violate the Law on Public Security Administration Punishment, and it is a kind of administrative punishment. The time limit for combined execution of detention shall not exceed twenty days.

2. The period of criminal detention is 14 days, and the detention period is at least one day from the time of entering the detention center. 14 days, the investigation organ reported to the procuratorate for approval of the arrest, and the time for the procuratorate to approve the arrest was 7 days, which was counted as 14 days, so the relevant compulsory measures should be lifted or changed. The extended period of criminal detention is 37 days.

3. In judicial custody, for at least one day and at most fifteen days, the court handed the detainee over to the public security organ for custody. If he refused to accept it, he applied to the court for reconsideration. When the detention period expired, the court decided to explain or release him in advance.

The concept of detention center:

Detention center is not a prison. Detention center and prison are two different places of detention. Detention centers generally hold criminal suspects who have not yet made a judgment and criminals whose remaining sentences are less than three months, while prisons generally hold criminals who have been sentenced to suspended death, life imprisonment or fixed-term imprisonment. After the criminal judgment takes effect, the people's court will serve the case documents to the designated prison. After being accepted by the prison, it should be registered in time so that the prisoner can serve his sentence within the time limit determined by the judgment.

To sum up, there are different legal provisions at different stages, and there is no time limit in theory.

Legal basis:

Article 9 1 of the criminal procedure law

If the public security organ deems it necessary to arrest the detained person, it shall submit it to the people's procuratorate for examination and approval within three days after detention. Under special circumstances, the approval time can be extended by one to four days. For major suspects who commit crimes on the run, commit crimes many times or commit crimes in collusion, the time for submitting for examination and approval may be extended to 30 days. The people's procuratorate shall, within seven days after receiving the approval letter from the public security organ, make a decision on whether to approve or disapprove the arrest. If the people's procuratorate does not approve the arrest, the public security organ shall immediately release it after receiving the notice and promptly notify the people's procuratorate to execute it. Those who need to continue the investigation and meet the conditions of obtaining a guarantor pending trial or residential surveillance shall be granted a guarantor pending trial or residential surveillance according to law.
