Article 1 In order to invigorate and manage urban and rural fair trade, expand commodity circulation, promote commodity production, invigorate urban and rural economy, and facilitate people's lives, these Provisions are formulated in accordance with the State Council's Measures for the Administration of Urban and Rural Fair Trade and relevant laws and regulations, combined with the actual situation of this Municipality.

Article 3 The competent department of market administration is the administrative department for industry and commerce. The price, taxation, health and public security management of the market shall be implemented by the competent departments in coordination.

Districts and counties shall set up a market management committee, presided over by the district and county magistrate in charge, and attended by departments of industry and commerce administration, commerce, supply and marketing, grain, agriculture, animal husbandry and fishery, price, measurement, taxation, health, sanitation, public security and municipal engineering. According to the needs of townships and towns, grass-roots market management committees can be established.

The responsibilities of the Market Management Committee are: coordinating and organizing relevant departments to jointly manage the market, supervising and inspecting the implementation of relevant laws and regulations, planning market construction, and studying and solving relevant problems of market management.

The district and county administrative departments for industry and commerce shall set up management institutions in the market, equipped with full-time management cadres.

Fourth market venues should be included in the urban construction planning, set up reasonably, and no unit or individual may occupy them.

New residential areas and satellite towns should be included in the supporting plan of public buildings. Combined with the planning and construction of commercial and service outlets, the indoor market shopping malls will be built.

The transformation of the old city and the construction of rural market towns should be combined with the setting of commercial outlets in the central food market and market towns, and indoor market shopping malls or shed-top market shopping malls should be built.

Article 5 The establishment of a market shall be based on the principle of not obstructing traffic and facilitating the purchase and sale of the masses, and shall be approved by the district and county people's governments.

The market must not occupy the road. Has occupied the road, it should create conditions to gradually move indoors; If temporary occupation is really necessary, it shall be handled in accordance with the relevant provisions of the current traffic road management of the Municipal People's Government.

Article 6 Units and individuals engaged in business activities in the market must abide by these Provisions.

Chapter II Industry Management

Article 7 State-owned and collective industrial and commercial enterprises may, in accordance with the approved business scope, conduct purchase and sale activities in the market.

Individual industrial and commercial households, with the business license issued by the administrative department for industry and commerce, can set up their stalls in the market according to the approved business scope.

Article 8 Rural cooperative commercial enterprises and individuals engaged in perennial or seasonal operations in rural areas may operate the commodities that are allowed to enter the market with the business license or temporary business license issued by the local administrative department for industry and commerce, and are not limited by administrative divisions and quantity. Anyone who traffics in meat food shall also hold a certificate from the veterinary quarantine or food hygiene supervision institution of the place of origin.

Artisans with licenses issued by the administrative department for industry and commerce can repair, process or sell handmade products on behalf of customers in the market.

Tenth medical practitioners in this city can practice medicine in the market with the business license or diagnosis certificate issued by the district and county health departments and the business license issued by the administrative department for industry and commerce.

Eleventh organs, organizations, military units, schools, enterprises, institutions and other units in the market procurement of agricultural and sideline products, are not allowed to raise prices to buy, resell.

Article 12 Except for agricultural and sideline products that are not allowed to be listed freely according to state regulations, other agricultural and sideline products are allowed to be sold in the market.

Article 13 Industrial products, individual industrial products, handicraft products and farmers' household sideline products that the state allows enterprises to sell themselves are allowed to be sold in the market.

Article 14 It is allowed to sell used bicycles and motorcycles in the designated market with vehicle license plate, identity certificate or unit certificate, and to sell used agricultural machinery and materials with identity certificate or unit certificate.

Fifteenth the sale of large livestock, must hold the certificate of grass-roots administrative units and veterinary quarantine institutions, shall be allowed to sell in rural markets. Large livestock without sales certificates and quarantine certificates are not allowed to be sold, purchased or slaughtered.

It is not allowed to sell young birds, young livestock and domestic animals in urban markets.

Sixteenth the following items are not allowed to be sold in the market:

(5) Poisonous, harmful, unclean, rotten and moldy foods, poultry, livestock, aquatic products and their products that have died of illness, poisoning or unknown causes, raw and small water products, and other foods that are not allowed to be sold as stipulated by the municipal public health administrative department;

(6) Control knives, inflammable and explosive articles, superstitions and contraband;

(7) reactionary, absurd and obscene books, periodicals, pictures, photographs, records, audio tapes, video tapes and other products;

(8) Narcotic drugs, toxic drugs, psychotropic drugs, toxic substances, counterfeit drugs and inferior drugs;

(9) Other articles prohibited from entering the market as stipulated by the state.

Seventeenth unlicensed traveling doctors and drug dealers are not allowed to practice medicine and sell drugs in the market.

Eighteenth prohibit shoddy, fake, adulterated, short scale.

Article 19 It is strictly prohibited to form alliances, buy and sell, hoard and drive up prices to dominate the market.

Twentieth units and individuals engaged in business activities in the market, should be in the market management agencies designated lots of business.

Twenty-first set up stalls in the market, should be required to pay the market management fee to the Municipal Administration for Industry and commerce. Market management fees shall be applied to the market and shall not be used for other purposes.

Veterinary quarantine institutions may collect quarantine fees according to regulations.

Other units are not allowed to make excuses to collect fees in the market.

Twenty-second all tax paying units and individuals must pay taxes in accordance with the provisions of the tax law and tax administration, and accept the supervision and inspection of the tax authorities. Tax evasion shall be dealt with by the tax authorities in accordance with relevant regulations.

Individual industrial and commercial households should establish simple purchase and sale account books and use the Uniform Invoice of Individual Industrial and Commercial Enterprises in Shanghai printed by Shanghai Taxation Bureau.

Twenty-third markets should set up a fair scale.

The measuring instruments used in commodity sales shall comply with the provisions of the measurement management department.

The sale and use of unqualified measuring instruments shall be handled by the measurement management department in accordance with relevant regulations. Those who cheat and seek illegal benefits by using measuring instruments shall recover their illegal income and be fined.

Article 24 The following illegal acts shall be dealt with by the administrative department for industry and commerce according to different situations:

(a) engaged in the purchase and sale activities without approval or operating without a license, to be educated to stop; Those who don't listen to education may be fined.

(2) If the transaction has not been established at the designated place, it is suggested to trade at the designated place; People who don't listen to advice may be fined.

(three) evasion of market management fees, in addition to ordering them to pay in full, can be fined.

(four) the sale of cultural relics, jewelry, jade, gold and silver and their products and foreign goods that are not allowed to enter the market according to state regulations, and order them to sell in the purchasing units designated by the state; Those that have been sold or resold shall be punished according to the relevant laws and regulations of the state.

(five) the sale of agricultural and sideline products and industrial products that are not allowed to be sold in the market, and the commercial department may purchase them when necessary; Those that have been sold shall be fined.

(6) If grain is purchased from the State Grain Depot or sold from residents at high prices in exchange for commodities, part or all of its grain and payment shall be confiscated; Refuses to correct, plus a fine; If the circumstances are serious, the punishment will be aggravated.

(seven) the purchase and sale of unplanned supply tickets or tickets in exchange for goods, the tickets, goods and illegal income shall be confiscated; Those who refuse to mend their ways after repeated instruction shall be fined.

(ten) shoddy, fake, adulterated, short scale, shall be ordered to compensate the buyer's losses, fake and shoddy goods shall be confiscated; Refuses to correct, plus a fine; For industrial and commercial enterprises or certified individual industrial and commercial households, they can suspend business for a short time until their business licenses are revoked; If the circumstances are bad and the consequences are serious, it shall be treated as speculation.

(eleven) gang, buy and sell, hoard, drive up prices and other acts of bullying, shall be punished as speculation.

(twelve) in violation of the provisions of the state and other regulations are not allowed to enter the market sales of other commodities, according to their different circumstances, to give education, fines, confiscation of goods and other treatment.

Article 25 Where young fish and crabs are sold, and aquatic products are stolen, robbed, poisoned or fried, the administrative department for industry and commerce shall cooperate with fishery administration and public security departments to deal with them in accordance with the relevant provisions of this Municipality on aquaculture protection.

Twenty-sixth people who are dissatisfied with the handling by the administrative department for industry and commerce may complain to the administrative department for industry and commerce at the next higher level within fifteen days after handling.

Twenty-seventh market managers in violation of the provisions of favoritism, shall be given a heavier punishment.

Chapter III Price Management

Twenty-eighth state-owned and collective commercial enterprises selling agricultural and sideline products in the market, where the state has price regulations, shall implement the price stipulated by the state; If the purchase and sale are discussed, it shall be implemented in accordance with the range of varieties and pricing principles stipulated by the state.

Other units and individuals selling agricultural and sideline products shall, within the scope permitted by national laws and policies, be determined by the buyers and sellers through consultation.

Twenty-ninth industrial products sold by state-owned and collective industrial and commercial enterprises shall be executed at the prices stipulated by the state.

Individual traders may not buy industrial products with prescribed prices from state-owned enterprises at retail prices higher than those stipulated by the state.

The prices of products produced by individual handicraftsmen and household sideline businesses shall be determined independently by the buyers and sellers within the scope permitted by national laws and policies.

Article 30 The transaction price of secondhand goods shall be determined by the buyer and the seller through consultation. But the old industrial products shall not exceed the retail price of similar new products stipulated by the state.

Article 31 When selling commodities in the market, it is forbidden to drive up prices. Fixed shops and stalls should be clearly marked.

It is not allowed to arbitrage the goods supplied by shops and vegetable markets at the prescribed retail price and sell them at a higher price.

Those who snap up or buy goods supplied at the retail price stipulated by the state and sell them at a higher price shall be fined in accordance with the regulations.

Chapter IV Health Management

Thirty-second in accordance with the "People's Republic of China (PRC) Food Hygiene Law" (Trial) and "Shanghai Urban and Rural Fair Trade Food Hygiene Management Regulations", strengthen the food hygiene management of fair trade.

Note (1) This Law shall be abolished as of the date of implementation of the Food Sanitation Law of People's Republic of China (PRC) (1995 10.30).

Thirty-third market management agencies should be equipped with food hygiene inspectors, responsible for the inspection of general food hygiene and veterinary quarantine certificates.

District and county food hygiene supervision institutions are responsible for the technical training and business guidance of food hygiene inspectors in the market.

The food hygiene supervision institution is responsible for the supervision and inspection of food hygiene.

Article 34 All kinds of food sold in the market, containers, packaging materials and utensils for holding food, and cookware and tableware used in food stalls shall conform to the national and municipal standards and regulations on food hygiene.

Thirty-fifth in violation of the provisions of article sixteenth (five), by the food hygiene supervision institutions according to law; If serious consequences are caused, resulting in death or disability, the public security and judicial organs shall deal with them according to law.

Thirty-sixth market management agencies should have a special person responsible for the management of market environmental sanitation. Stallers must keep booths and scaffolding clean and tidy, and do a good job in public health.

Chapter V Administration of Public Security

Thirty-seventh market management institutions should be equipped with public security pickets, responsible for maintaining public security and traffic order in the market. Market security pickets are guided by the local public security organs in their business, and they should wear the duty signs formulated by the public security organs when performing their tasks.

Public security organs should strengthen the public security management of fairs.

Thirty-eighth gambling, divination and fortune telling are strictly prohibited in the market; It is strictly forbidden to engage in street performing activities that are immoral, barbaric, horrible, destroy the physical and mental health of actors and corrupt socialist spiritual civilization. Offenders shall be dealt with by public security organs according to law.

Thirty-ninth in violation of the provisions of article sixteenth (six), (seven) and (eight), all items and illegal income shall be confiscated by the public security organs; If the circumstances are serious, the public security and judicial organs shall handle it according to law.

Article 40 Robbery, pickpocketing, theft, fraud, molestation of women, fighting with others, unauthorized engraving of official seals, alteration, forgery of certificates, receipt of stolen goods, sale of stolen goods and other hazards to social order shall be dealt with by public security and judicial organs according to law.

Article 41 Whoever attacks market management organizations, hinders market managers and tax collectors from performing their duties according to law, impersonates market managers and tax collectors for extortion, and seriously disrupts market order, shall be dealt with by public security and judicial organs according to law.

Chapter VI Supplementary Provisions

Article 42 These Provisions are approved by the Standing Committee of the Shanghai Municipal People's Congress and promulgated by the Shanghai Municipal People's Government, and shall come into force as of 1 August 9851day. The Interim Measures for the Administration of Agricultural and Sideline Products Market in Shanghai approved by the Shanghai Municipal People's Government shall be abolished at the same time.

Forty-third state-owned and collective enterprises to set up agricultural and sideline products trading market, with reference to these provisions.

Article 44 The Shanghai Administration for Industry and Commerce may formulate detailed rules for implementation according to these Provisions, which shall be implemented after being approved by the Shanghai Municipal People's Government.
