Opinions on further strengthening the management of examination and approval of rural housing construction (for Trial Implementation)

Villages (communities) and related units:

In order to further standardize the management of rural housing construction plan in our town, optimize the spatial layout of villages and towns, and economize on intensive use of land resources, according to the People's Republic of China (PRC) Urban and Rural Planning Law, the Land Administration Law of the People's Republic of China, the Regulations on Urban and Rural Planning of Jiangsu Province, the Guidelines for Village Planning of Jiangsu Province and other relevant laws and regulations, combined with the actual situation of our town, we hereby put forward the following implementation opinions:

First, strict planning and control.

The examination and approval of housing construction must conform to the overall planning of our town, and be examined and approved in strict accordance with the prescribed procedures:

(1) Examination and approval of houses in the planning control area

1. Planning control area (roads, greening, rivers, etc. Involving the overall planning of Huangli Town), the examination and approval of new residential buildings will be stopped, and only repairs and reinforcement can be carried out, and the leaky building will be changed to a sloping roof.

2. If it is confirmed that it is indeed a household with housing difficulties and dangerous houses (see Annex 1 for specific conditions), it can apply for business in accordance with the relevant policies on the reform of the homestead system.

(two) the approval of housing outside the planning control area.

Actively guide the centralized residence outside the planning control area. Village (neighborhood) committees should take effective measures to guide villagers' houses to be built in accordance with the overall planning, and if conditions permit, they should concentrate on building central villages. Adhere to the principle of one household, one house, determine the application qualification in strict accordance with the "Regulations on Land Management in Jiangsu Province" and other laws and regulations, and control the construction scale.

2, clear construction conditions

1, the village committee (neighborhood committee) should strictly examine the application of farmers for building land, and strictly examine and report the "five rejections". That is: the site selection does not meet the planning and will not be accepted; Do not meet the conditions of "one household, one house" will not be accepted; The land area exceeding the prescribed standard will not be accepted; Do not accept the lease, sale or other forms of illegal transfer of homesteads and buildings on the ground, and use the homesteads for other purposes; Disputes will not be accepted.

2. Non-agricultural registered permanent residence residents in cities and towns, workers who have returned to their original places to settle down, demobilized soldiers, retired cadres, etc. (including the household registration personnel who have not assumed the obligations and responsibilities of the villagers' group) shall not arrange the homestead to build houses.

3. The house reconstruction in Huangli Town (scope: west of Zhongxin Road, north of Jingwei No.1 Road, east of Line 239 and south of Park Avenue) must conform to the architectural style of the area, especially the houses built along the street. On the basis of unified planning, the facade style and design requirements must be unified and coordinated. The architectural style and elevation are decided by the town government.

4. When the house is rebuilt, it shall not affect the legitimate rights and interests of neighboring people such as sunshine, ventilation, lighting, transportation, water supply and drainage, and shall not affect the requirements of fire protection, transportation, infrastructure, public facilities, public green spaces, etc.

Third, strengthen examination and approval management.

In line with the planning and new construction and renovation of housing conditions, according to the following procedures for approval (see Annex 2 for the approval flow chart):

1, apply. The villagers apply to the village committee (neighborhood committee) for building houses, and the new construction and reconstruction must conform to the overall planning of the village, within the scope of the original homestead, not exceeding the original homestead permit area and original height. If it is really necessary to expand the area, it must be approved by the land department.

2, the survey site, the neighbor's signature. The village committee (neighborhood committee) shall contact the relevant functional departments of the town to conduct on-site investigation, and the on-site investigators shall verify the situation of the proposed building and put forward preliminary opinions. In line with the relevant housing conditions, the applicant will find four neighbors to sign and coordinate the relevant contradictions. After the neighbors sign without objection, the town construction management shall be reported to the leaders in charge of the town for review.

3. Go through the relevant formalities. With the consent of the local villagers' groups and village committees (neighborhood committees), it shall be reported to the town construction management department and the land department for the procedures of land use certificate and planning permit (see Annex 3 for the required materials and Annex 4 for the application form), and reported to the relevant departments of the district for examination and approval.

4. Sign a letter of commitment. After obtaining the relevant procedures, the building owner signed a letter of commitment for standardization construction to the town management squadron (see Annex 5), and voluntarily paid the standardized construction deposit of RMB 0/00 yuan per square meter of construction area to the town management office.

5. On-site line inspection. Before the start of construction, the owner of the building shall apply to the local village committee (neighborhood committee) for setting out, and the village committee (neighborhood committee) shall, within 5 working days after accepting the application, set out in conjunction with the town construction management office, the land office and the urban management squadron. Construction shall not be started without lofting and line inspection. The town construction management office will also copy the red line map and related materials to the village Committee (neighborhood Committee), the town land office and the urban management squadron.

6. Completion acceptance. After the completion of the house, the local village committee (neighborhood committee) and the functional departments of the town have accepted it, which meets the pre-approval conditions. After being signed by the leaders in charge of the town, the villagers can return the deposit to the town construction management office within 5 working days by the receipt of rural housing in Huangli Town (see Annex 6).

Fourth, serious work discipline.

1. The villagers' committee (neighborhood committee) is the main body responsible for rural housing construction and management. Village committees (neighborhood committees), town construction management offices, land offices and urban management squadrons should strengthen daily inspections and supervision. Those who build houses without approval or in violation of laws and regulations will be severely punished and demolished in accordance with relevant laws and regulations.

2. The village committee (neighborhood committee) and various functional departments must adhere to the supervision principle of "before construction, during construction and after construction", and the relevant departments and the village committee (neighborhood committee) where they are located need to assign personnel and posts to be present for supervision during the initial, middle and completion period of construction. Timely stop and dismantle acts that are not implemented according to the planning permission.

3. At the end of the year, the town government will organize relevant functional departments to conduct a comprehensive assessment of the completion of the objectives and tasks of each village, and the assessment results will serve as an important basis for the performance assessment of each village (community).
