Article 2 Dismissal of professional and technical personnel and management personnel is a right of the unit, which means that the unit voluntarily dissolves the relationship with professional and technical personnel and management personnel through legal procedures due to legal reasons.
Article 3 The unit may dismiss professional and technical personnel and management personnel in any of the following circumstances who are ineffective after education:
(a) unable to complete the task for two consecutive years, and not subject to organizational arrangements or rescheduling, and still unable to complete the task within one year;
(two) the unit merger or downsizing needs to be reduced, and I refuse to organize the arrangement;
(three) the unit moved to the workplace, and I don't want to move with it without justifiable reasons;
(4) Being absent from work for more than fifteen consecutive days without justifiable reasons, or being absent from work for more than thirty days in one year;
(five) damage the economic rights and interests of the unit, causing serious consequences and serious violations of professional ethics, causing extremely bad influence in the unit;
(six) unreasonable, fighting, threatening the leadership of the unit, seriously affecting the work procedures and social order;
(seven) corruption, theft, gambling, graft, if the circumstances are serious enough for criminal punishment;

(nine) there are other serious mistakes.
Those who meet the conditions for dismissal shall be handled in accordance with the Interim Provisions of the State Council on rewards and punishments for staff of state administrative organs.
Fourth professional and technical personnel and management personnel in any of the following circumstances, the unit shall not be dismissed:
(1) Being injured, disabled or incapacitated on duty;
(2) Women during pregnancy, childbirth and lactation;
(3) The person who enjoys the vacation treatment is on vacation;
(four) suffering from terminal illness, mental illness and occupational disease;
(5) Meet other conditions stipulated by the state.
Article 5 When dismissing professional and technical personnel and management personnel, the relevant administrative leaders of the unit shall put forward written opinions, explaining the reasons and factual basis for dismissal. After discussion and decision by the collective leadership of the unit, the dismissal formalities shall be handled according to the personnel management authority, and the dismissal certificate shall be issued by itself and reported to the personnel department at the same level for the record.
Article 6 A party may apply to a local dispute arbitration institution for arbitration within 15 days after receiving the Dismissal Certificate. If the local arbitration institution has not been established, it shall be settled by the superior competent department of the unit where the dismissed person works. The dismissal shall be carried out at the time specified in the dismissal certificate.
Seventh units to dismiss professional and technical personnel and management personnel, should be issued to the dismissed personnel dismissal certificate. The dismissal fee shall be paid to the unit in one lump sum after completing the relevant formalities, and the Certificate of Dismissal Fee shall be stored in my file. The standard of severance payment is as follows:

Article 8 The dismissal fee shall be paid from the business expenses.
Ninth professional and technical personnel and management personnel who work in units owned by the whole people, collective ownership units and foreign-funded enterprises within one year after being dismissed shall retain their status as cadres owned by the whole people; If the dismissed personnel engage in self-employment, work in private enterprises or can't find a receiving unit within one year after being dismissed, they will no longer retain their status as cadres owned by the whole people.
The personnel flow service institution affiliated to the personnel department that manages the personnel files of the dismissed personnel is responsible for the examination and approval of their cadre status.
