Is the use of Chongqing road and bridge fees beyond the statutory scope of use?

According to reports, a recent article entitled "The compulsory administrative collection of road and bridge fees in Chongqing should be resolutely abolished" was widely reprinted in Tianya and other forums. This paper mainly questions the legality of the collection, including illegal decision-making procedures, violation of the new superior law, and the compulsory collection of road and bridge fees linked to the annual inspection of vehicles.

According to the report, regarding the current scope of road and bridge charges in Chongqing, relevant persons said that as long as the road and bridge charges are given the nature of administrative charges, road and bridge charges can be included in the management system of "collection", and public power means such as administrative coercion and punishment can be publicly used to escort the charges.

In the process of urban development, it is understandable that the government borrows money from the society because of temporary financial difficulties. However, Chongqing stipulates that "the road and bridge tolls collected are mainly used to pay road and bridge rental fees, road and bridge maintenance and management fees, loan principal and interest repayment fees, and road and bridge toll collection fees", which is beyond the scope and purpose authorized by the State Council.

Regarding the public's disclosure that Chongqing's annual inspection does not pay road and bridge fees, experts said that the Road Traffic Safety Law stipulates that no unit may attach other conditions to motor vehicle inspection except statutory conditions. This regulation in Chongqing has abused the licensing right and confused the legal relationship and legal procedure.
