How long does it take for Jaco and Ye to review the death penalty?

The review period of death penalty is generally more than two months. In judicial practice, the Supreme Court's review of major sensitive cases is very short, and some cases are less than one month. Under normal circumstances, the death penalty review procedure generally takes more than two months, and the approval of individual cases even takes several years.

The review procedure of death penalty refers to the special trial procedure that the Supreme People's Court and the Higher People's Court should follow when reviewing and approving cases that have been sentenced to death. The purpose of establishing the death penalty review procedure in China's law is for the people's court with the power of death penalty review to conduct a comprehensive review of whether the death penalty judgment and ruling submitted by the lower people's court are correct in ascertaining the facts and applying the law, and make a decision on whether to approve the death penalty according to law.

Legal basis:

Article 246th of the Criminal Procedure Law of People's Republic of China (PRC), the death penalty is approved by the Supreme People's Court.

Article 247 of the Criminal Procedure Law of People's Republic of China (PRC) stipulates that in a case of first instance in which the intermediate people's court sentenced the death penalty, if the defendant does not appeal, it shall be reviewed by the higher people's court and submitted to the Supreme People's Court for approval. If the Higher People's Court has any objection to the death penalty, it may send it back for retrial. In the case of first instance where the Higher People's Court sentenced the death penalty, the defendant did not appeal, and in the case of second instance where the death penalty was imposed, it should be reported to the Supreme People's Court for approval.
